Here are the terms and conditions included in our digital agreement and waiver! This is about a 5-minute read and will tell you pretty much everything you need to know about what you’re diving into.
You, (Student) agree to follow the rules of Sifu Mimi Chan, Wah Lum Kung Fu Temple, Inc. (Wah Lum) as outlined in these terms and conditions.
YOUR MEMBERSHIP IS FOR 12 WEEKS – January 31, 2021 – April 10, 2021. Why 12 weeks? Your 8 week membership includes 4 extra weeks of access!
ALL SALES ARE FINAL. All sales are final.
USE THEM OR LOSE THEM. With your Membership, you have been allotted 8 weeks of access to the MY COACH APP. Remote training includes all video tutorials and lessons while you are actively enrolled. Your access will end on April 10, 2021.
YOU AGREE TO BE NICE (DON’T BE AN @$$).You agree to keep and obey all rules and regulations now in force or in the future prescribed by Wah Lum, and Wah Lum reserves the right to revoke this membership for cause if you fail to keep and obey any such rules and regulations, or for reasons of nuisance, disturbance of other members or staff, moral turpitude (lol) or fraud. Without limiting your obligation to obey the rules and regulations of Wah Lum presently in force or in the future prescribed, you agree to obey the policies and procedures as described on the application.
THIS MEMBERSHIP BELONGS TO YOU. You can’t give it to anyone else. It is expressly understood and agreed that this agreement is not assignable or transferable by student and no rights or privileges granted by this Membership can be transferred or assigned by student.
WE CAN TAKE YOUR PIC, ‘CAUSE YOU BEAUTIFUL. Any pictures, audio, or visual recordings taken of you at Wah Lum or videos and images sent digitally to Sifu Mimi Chan may be used for publication, promotion, articles, shows, and advertisement without additional consent and without compensation. If you do not wish to allow photographs and videos of yourself to be used for promotional purposes, you must inform Wah Lum in writing.
PLEASE DON’T SUE US (LIABILITY WAIVER) You are working on your health and fitness at your own risk virtually. It is further agreed that all exercises including the use of weights, number of repetitions, and use of any and all machinery, equipment, and apparatus designed for exercising shall be at the Student’s sole risk. Notwithstanding any consultation on exercise programs which may be provided by Wah Lum employees or agents, it is hereby understood that the selection of exercise programs, methods and types of equipment shall be Student’s entire responsibility, and Wah Lum shall not be liable to Student or Student’s family for any claims, demands, injuries, damages, or actions arising due to injury to Student’s person or property arising out of or in connection with the use by Student of the services and facilities of Wah Lum or the premises where the same is located.
Student hereby holds Wah Lum its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by Student, on Student’s behalf, by Student’s family, and Student’s executors, administrators, and personal representatives for any such injuries or claims aforesaid and Student for himself and on behalf or his family, executors, administrators, and personal representatives does hereby forever release and discharge Wah Lum, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.
PHYSICIAN APPROVAL: I have represented to Wah Lum that I have either a) been given a physician’s permission to participate in the Training, or b) voluntary participate in the Training and all risks related to the Training without the approval of my physician(s). I represent that I am not aware of any medical or physical condition that would prevent me from participating in the Training or from using equipment or facilities which pose a serious health risk to me. I further acknowledge that Wah Lum has relied on my statements as being accurate and complete, as a condition to entering into this Agreement. I further acknowledge and agree that I am not obligated to participate in any Training that I do not wish to participate in. I will inform Wah Lum immediately if I do not wish to participate in any specific Training.
RENEWING or CONTINUING: The Student understands and agrees, that if student decides to continue classes or training with the instructor, to all terms and conditions of this agreement until a new contract has been signed.
I AM NOT UNDER THE INFLUENCE OF ANY DRUGS, ALCOHOL, OR INTOXICANTS. I AM NOT SUFFERING FROM ANY ILLNESS OR INCAPACITY.
I AM OVER 18 YEARS OF AGE.
I ACKNOWLEDGE THE AGREEMENT TERMS OUTLINED ABOVE AND THAT THIS IS A LEGALLY-BINDING CONTRACT AND MY DIGITAL SIGNATURE IS THE SAME AS MY FANCY SIGNATURE AND WILL HAVE THE SAME LEGAL EFFECT AS A HANDWRITTEN SIGNATURE.
